We attach great importance to data protection. Personal data is processed in compliance with the applicable data protection laws, in particular the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

Our online offering is primarily directed at businesses, authorities and other organisations (B2B). In addition, end customers may contact us, in particular via service or repair requests. In such cases we process personal data to the extent necessary to handle the request.

Personal data within the meaning of Art. 4(1) GDPR is any information relating to an identified or identifiable natural person, e.g. name, address, e-mail address or IP address.

1. Controller

Controller pursuant to Art. 4(7) GDPR:

UTG Europe GmbH
Am Bahndamm 7
63683 Ortenberg
Germany

E-mail: info@utgeurope.com

2. Processing when visiting the website (server log files)

When you visit our website, the web server automatically processes personal data in so-called server log files. These include in particular:

  • IP address,
  • date and time of access,
  • requested page / file,
  • referrer URL,
  • browser type and operating system.

Processing is carried out to ensure technical operation, IT security and for error and abuse analysis. The legal basis is Art. 6(1)(f) GDPR (legitimate interests).

Storage period: Log files are stored for a limited period and then deleted, unless security-relevant events require longer retention (e.g. pursuant to German commercial or tax retention obligations such as Sec. 257 HGB or Sec. 147 AO).

3. Cookies / session cookies

We only use technically necessary cookies (e.g. session cookies) that are required for operating the website and protected functions. The legal basis is Art. 6(1)(f) GDPR and, where applicable, Art. 6(1)(b) GDPR.

You can deactivate cookies in your browser settings. In that case, the functionality of the website may be limited.

4. Contact / service and repair requests

If you contact us by e-mail or via a service or repair form, we process the personal data you provide (e.g. name, contact details, device or issue description) insofar as this is necessary to handle your request.

In addition, technical evidence data such as IP address and the time of the request may be processed to prevent abuse.

The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures / contract performance) and Art. 6(1)(f) GDPR (legitimate interests).

Storage period: The data will be deleted after the request has been finally processed, unless statutory retention obligations require longer storage (e.g. Sec. 257 HGB or Sec. 147 AO).

5. Business relationships (B2B)

In the course of business relationships we process business master data, contact data, contract, delivery and billing data for the initiation, performance and handling of the business relationship.

Providing this data is necessary for concluding and performing a contract. Without this information, a contract cannot be concluded.

The legal basis is Art. 6(1)(b) GDPR and Art. 6(1)(c) GDPR (legal obligations).

6. Recipients of personal data

Recipients of personal data may in particular include:

  • IT and hosting providers (processors pursuant to Art. 28 GDPR),
  • shipping and logistics service providers,
  • banks and payment service providers,
  • tax advisors, auditors and authorities, insofar as legally required.

7. Transfers to third countries

We do not transfer personal data to countries outside the EU/EEA and we do not intend to do so.

8. Data subject rights

Data subjects generally have the right to:

  • access (Art. 15 GDPR)
  • rectification (Art. 16 GDPR)
  • erasure (Art. 17 GDPR)
  • restriction of processing (Art. 18 GDPR)
  • data portability (Art. 20 GDPR)
  • object (Art. 21 GDPR)
Notice of the right to object (Art. 21 GDPR):
You have the right to object at any time to the processing of personal data concerning you. We will stop processing your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

You also have the right to lodge a complaint with a competent supervisory authority.

9. Data security

We implement appropriate technical and organisational security measures to protect personal data against loss, manipulation and unauthorised access.
